Autoptic Product Warranty Terms
Autoptic Cameras have a one year manufacturer warranty and accessories carry a 6 month warranty period from the date of purchase.

Our units are engineered and manufactured with strict quality standards to ensure the longevity of the device. As such we stand behind our products and want to ensure that you are completely satisfied with your purchase.


1. Orders, price and payment

1.1. All orders are subject to acceptance by us in writing (which may include via our website). Any order accepted by us will be on these terms only, and results in a separate binding agreement between you and us for the supply of those Goods. These terms are paramount and take precedence over any terms which may be offered by you.

1.2. Unless otherwise stated in writing, all prices are in Australian dollars, exclude duties, withholdings or taxes imposed by any governmental authority, exclude delivery costs, and are subject to change without notice.

1.3. Where more than one Customer has entered into this Agreement, the Customers shall be jointly and severally liable for all payments for Goods and all other obligations and liabilities under this Agreement.

1.4. We reserve the right to correct clerical errors (including pricing errors) without notification.


2. Cancellation

2.1. We may cancel any order (including any accepted order) or delivery of Goods at any time before the Goods are delivered by giving written notice. On giving such notice we shall repay to you any sums paid in respect of the Goods, less any amount owing by you to us for any reason. We shall not be liable for any loss or damage whatsoever arising from such cancellation.


3. Delivery, risk and ownership

3.1. Where we agree to deliver the Goods to a specified place, we will deliver (or arrange delivery of) the Goods to that place. Unless otherwise agreed, delivery will be at your expense.

3.2. If no place of delivery is specified, delivery shall take place at the time when the Goods are made available for dispatch by us.

3.3. We reserve the right to part deliver. We will in no event be liable for any late delivery, and you shall not be entitled to cancel your order or claim compensation by reason of late delivery or failure to meet your particular delivery requirements.

3.4. You shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. In the event that you are unable to take delivery of the Goods as arranged then we shall be entitled to charge a reasonable fee for redelivery and for holding the Goods pending redelivery.

3.5. We shall not be liable in anyway whatsoever for any delay or breach of this Agreement caused directly or indirectly by war, act of God, strike, lockout, riot, government action or interference, fire, earthquake, material shortage, late or non-delivery by manufacturer, shipping or transport delay or any other cause beyond our reasonable control. You shall be bound to accept and pay for Goods delivered within a reasonable time after the cause of the delay or breach.

3.6. You shall inspect the Goods immediately on delivery and shall within 48 hours of the delivery notify us in writing of any alleged defect, shortage in quantity, damage, or failure to comply with the description or quote. If you fail to do so, the Goods shall be deemed to be free from any defect, damage, non-compliance or short-delivery and you shall be deemed to have accepted the Goods as-is.

3.7. Risk in the Goods shall pass to you when the Goods are dispatched or delivered, whichever is earliest.


4. Returns

4.1. We may, at our discretion, accept the return of Goods by you for credit within 7 days of dispatch. Goods will only be considered for return if they are in original sale condition including all packaging, accessories and documentation, and are accompanied by a copy of the invoice for the Goods and a statement providing full reasons for the requested return.

4.2. For defective Goods, which we agree in writing that you are entitled to reject, our liability is limited to either (at our discretion) replacing the Goods (either with the same or equivalent goods), repairing the Goods or crediting the price paid for the Goods.

4.3. Where Goods are sold with a written money-back guarantee, Goods may be returned for a refund of the price paid for the Goods if returned to us (at your expense) within the stated money-back guarantee period and in original sale condition, including all packaging, accessories and documentation.

4.4. We may require you to return Goods to us in the event of a product recall. In such event, we may (at our election) replace the Goods (with the same or equivalent goods) or repair the Goods, or credit the price paid for the Goods.

4.5 Return Postage Costs is the responsibility of the customer. All refunds/exchanges/credits will be paid by the cost of the products purchased at the time of invoice, excluding any postage costs associated with the order.

4.6 If the product is found to be faulty by our technicians/manufacturer within the Warranty Period- and is a result of abnormal use or damaged by misuse-then a refund or exchange cannot be offered. We will provide you an option to have the product repaired or replaced at your expense.

4.7 Where there is no fault found- the product will be returned to the customer-at the expense of the customer.

4.8 Where a fault has been determined by us- as a result of a manufacturers defect- then the full postage costs-as incurred by the original sale- of returning the product to us will be refunded together with the cost of the products purchased at the time of invoice. When assessing product faults, it is necessary that the customer contacts us prior to returning the product so as to seek remedy for any issues.


5. Warranties

5.1. Subject only to clause

5.2, to the maximum extent permitted by law we disclaim all implied warranties including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement of title, with regard to the Goods.

5.2. Where Goods are sold with an Express Warranty, we warrant the Goods only for the Warranty Period. You may during the Warranty Period notify us in writing of any defect or suspected defect in the Goods, providing full details of the defect or suspected defect, and returning the Goods to us (at your expense) for inspection. Upon receiving the same, we shall, to the extent necessary, inspect, replace, substitute with equivalent goods, or repair (at our discretion) the Goods at our cost (subject to any further terms of the Express Warranty).

5.3. We shall not be liable under clause 5.2, and any Express Warranty shall be voided and will not apply, for any defect or damage that follows or is the result (directly or indirectly) of:
(a) Operation of the Goods other than in accordance with all manuals, instructions, guidelines and other documentation supplied with the Goods or made available on our website;
(b) Improper use or the Goods, or use of the Goods in a manner not reasonably contemplated by us;
(c) Modification or repair of the Goods not authorised in writing by us;
(d) Use of the Goods in a manner contrary to law;
(e) Subjection of the Goods to unusual or un recommended physical, environment or electrical stress;
(f) Incompatibility between the Goods and any other device, component, vehicle or thing not expressly confirmed by us to be compatible with the Goods;
(g) Use of the Goods by a person other than you; (h) Your failure to comply with any terms of this Agreement;
(i) Your failure to make any changes or enhancements recommended by us.

5.4. Unless otherwise stated in writing, our sole liability under an Express Warranty shall be to repair, replace or substitute with equivalent goods (at our election) the Goods.

5.5. You acknowledge that the Goods are bought relying solely upon your skill and judgement.

5.6. Nothing in these terms and conditions is intended to limit or exclude any liability that cannot be excluded by law. Statuary conditions and warranties apply. Nothing in these Terms and Conditions excludes the application of those statutory conditions and warranties.


6. Consumer Guarantees

6.1. If the Goods are acquired by you for business purposes, you agree that any Consumer Guarantees Act does not apply.

6.2. We do not undertake that repair facilities or parts will be available for the Goods.


7. Specifications

7.1. We may substitute the Goods or any component of the Goods, and may in any other respect modify the Goods, prior to delivery without consultation with you if, in our reasonable opinion, such substitution or modification will not: (a) Adversely affect the performance or capacity of the Goods; (b) Alter the configuration of the Goods in any material respect; or (c) Otherwise materially affect our obligations or prejudice your rights under this Agreement.


8. Installation, training, support

8.1. Unless otherwise agreed in writing, the price does not include installation, maintenance, training or support.

8.2. You are responsible for installation of the Goods, which you undertake at your own risk. You must ensure that the Goods are safe to install in any particular vehicle, device or object.

8.3. You warrant that your use of the Goods will comply with all applicable laws and regulations, and that you will not use the Goods for any unlawful purpose.
